2. All participants confirm that they are in good health and have no health condition or illness that may make their participation in the Overseas Adventure trip injurious to them or others.
3. The participation in the Overseas Adventure trip naturally involves risk of injury to the participant, whether caused by the participant or by someone else. The participant understands and voluntarily accepts this risk and agrees not to hold MIR, or its members liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss, or any damage to the participant, or his/her relatives resulting from the participation of anyone in the trip or acts of MIR employees or agents.
The participant agrees to bear responsibility for all liabilities and damages arising from any injury, including, without limitation, personal, bodily, or mental injury, economic loss, or any damage to another participant caused by a deliberate or negligent action of the participant him/herself. If any claim is made by anyone based on injury, loss or damage described here, which involves the participant, the participant agrees to
(i) defend MIR against such claims and fully indemnify the Trip Leader for all costs and expenses whatsoever relating to the claim and
(ii) fully indemnify MIR for all liabilities whatsoever including the participant and his/her spouse, unborn child, relatives or anyone else, resulting from such claims.
4. MIR shall not be responsible in the event of lost, damaged or stolen personal property during the trip.
5. MIR will accept no liability for any damage, losses and expenses suffered by any client
as a result of sickness, quarantine, weather conditions, war, strikes, riots, flight delay or any other cause outside our control.
6. MIR reserves the right to terminate without prior notice, the participation in the Overseas Adventure trip of any participant found in breach of the terms and conditions of the Overseas Adventure trip or/and if the participant’s actions are detrimental to the equipment and/or the welfare of other members, participants or employees, as well as for the non-payment of any balances due and payable by the participant. No refund in respect of fees paid will be made.
7. The nature of participation in this Agreement is exclusive. The rights of participation shall be enjoyed only by the participant.
8. A non-refundable deposit stipulated by the trip leader depending on trip requirement is needed upon signing up for the Overseas Adventure trip.
9. In the event of any cancellation of trip after confirmation, notification of cancellation must be made in writing.
The cancellation charges imposed will be as follow:
- 30 days prior to departure: Deposit and non recoverable incurred expenses forfeited
- 15 – 30 days prior to departure 70% of total amount
- 8 – 14 days 80% of total amount
- 7 days prior to departure 100% of total amount
- No show No refund
MIR reserves the right to cancel the trip prior to departure for any reason whatsoever, including insufficient signup or due to logistical problems that do not allow for the safe conduct of the trip. All costs paid by participants will be refunded in full by the Trip Leader. However, the Trip Leader is not responsible for nonrecoverable expenses incurred by participants such as non-refundable advance purchase of air tickets, visa fees, equipment, etc.
